Controlled Substances

Under the Uniformed Controller Substances Act, it is unlawful for any person to manufacture, deliver, or possess with intent to manufacture or deliver a controlled substance.

Controlled Substances include, but are not limited to:

  • Ecstasy

  • Heroin

  • LSD

  • Marijuana

  • Cocaine

  • Fentanyl

  • Methamphetamine

  • Ketamine

  • Benzodiazepines

You may be charged with possession with intent to deliver even if delivery has not taken place yet. The State need only prove that the intent to deliver the controlled substance exist, which may be demonstrated through circumstantial evidence such the quantity found or the attempt to deliver.


A civil asset forfeiture case may also arise from a substance related crime.

The following personal and real property are subject to seizure and forfeiture by law enforcement:

  • Controlled substances and raw materials in violation of the law

  • Vehicles or other property used to facilitate the sale, delivery, or receipt of controlled substances

  • Real property used with the knowledge of the owner for the manufacturing, compounding, processing, delivery, importing, or exporting of any controller substance

  • Money or property of value furnished in exchange for controlled substances in violation of the law.
